Terms of Service
Welcome to Wellness Marketplace (“we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of our website, applications, and services (the “Services”). By using the Services, you agree to these Terms.
1. Our Service
We operate an online marketplace for wellness products and services. You may browse products, place orders, schedule appointments, and manage prescriptions/refills where applicable. Certain features require an account.
2. Accounts & Eligibility
- You must provide accurate information and keep your account secure. Do not share credentials.
- You must be at least 16 to use the Services; some products/services may require you to be 18 or older.
- We may suspend or terminate accounts for violations of these Terms, suspected fraud, or risk to users.
3. Ordering, Pricing & Payments
- Placing an order is an offer to purchase. We may accept or reject for lawful reasons (e.g., availability, verification, risk checks, regulatory requirements).
- Prices are shown in your selected currency where supported and may exclude taxes, duties, and shipping unless stated. Errors may be corrected.
- Payments are processed by third-party providers; we do not store full card numbers. You authorize us to verify payment and perform anti-fraud checks.
- We may limit or cancel quantities purchased per person, household, or order where appropriate.
4. Prescriptions, Clinical Use & Appointments
- Some items require a valid prescription or a consultation with a qualified practitioner. You authorize us to verify prescription/refill eligibility to fulfill your order.
- Clinical content on the site is informational only and not a substitute for professional medical advice. In emergencies, call local emergency services.
- Appointments (telehealth or in-person) are subject to provider availability and applicable professional standards. You must provide accurate medical information.
- Cancellation & no-show: Missed or late cancellations may incur fees—see your appointment confirmation for details.
5. Shipping, Delivery & International Orders
- Estimated delivery dates are not guaranteed. Risk of loss passes on delivery in accordance with carrier terms.
- International customers are the importer of record and are responsible for customs duties, taxes, and compliance with local laws. Some products may not be available in certain jurisdictions.
- We may refuse, delay, or cancel shipments to comply with legal/regulatory requirements or risk controls.
6. Refunds, Returns & Cancellations
- Refund eligibility depends on product type, condition, and timing. Prescription items and certain health/medical products may be non-returnable where prohibited by law or safety policy.
- For eligible returns, items must be in original condition with all components. We may refuse returns that are used, opened (where hygiene/health rules apply), or not in resalable condition.
- Where refunds are approved, we process them to the original payment method when possible. Applicable statutory consumer rights remain unaffected.
7. Acceptable Use
- Do not misuse the Services, interfere with operation, scrape, or attempt unauthorized access.
- Do not post unlawful, harmful, misleading, or infringing content. We may remove content that violates these Terms.
8. Communications (Email, SMS, WhatsApp)
We may contact you about orders, appointments, and support via email, SMS, or WhatsApp (when you message us or consent). Marketing messages are optional; you can opt out at any time. For WhatsApp, you can reply STOP (or “UNSUBSCRIBE”) to opt out.
WhatsApp channel use: we use WhatsApp for permitted notifications and support only. We do not complete purchases of prescription, peptide-based, or other restricted healthcare items on WhatsApp; checkout occurs on our website/app.
9. User Content & Reviews
By submitting reviews or other content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content in connection with the Services. You must have rights to the content you submit. We may moderate or remove content that violates these Terms.
10. Intellectual Property
All site content (text, graphics, logos, software) is owned by us or our licensors and protected by law. You may not copy, modify, reverse engineer, or distribute without permission, except as permitted by mandatory law.
11. Disclaimers
Except as required by law, the Services are provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant uninterrupted or error-free operation. We do not provide medical advice; consult qualified professionals for medical decisions.
12. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits. Our aggregate liability for claims relating to the Services will not exceed the amount you paid in the 6 months preceding the claim. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law, and your statutory consumer rights remain unaffected.
13. Indemnity
You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising out of your misuse of the Services or violation of these Terms or applicable law.
14. Marketplace Roles
Some items or services may be offered by third-party vendors or practitioners. We may act as the platform provider and/or merchant of record depending on the product/service. Where a third party is the seller, they are responsible for compliance with applicable laws and their own terms; we will identify the seller at checkout or in the order confirmation.
15. Changes to the Services & Terms
We may update the Services and these Terms. We will post updated Terms with a new effective date. If changes are material, we will provide additional notice where required. Continued use after changes constitutes acceptance.
16. Termination
We may suspend or terminate your access at any time for violation of these Terms, legal requirements, or risk to users. You may stop using the Services at any time. Sections intended to survive termination (e.g., IP, disclaimers, limitations, indemnity) will continue to apply.
17. Governing Law & Jurisdiction
These Terms are governed by the laws of England and Wales, without regard to conflict-of-law rules. If you are a consumer resident in the UK or EU, you may bring claims in your local courts, and mandatory consumer protections in your country of residence remain unaffected.
18. Complaints & Contact
If you have a complaint, please contact us first so we can try to resolve it promptly. Email: privacy@wellnessmarketplace.com.
